SciFig Terms of Service for Research Platform

1. Your Agreement to These Terms

These Terms form a legally binding agreement between you and SciFig. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must immediately stop using the Services. Your access to and use of the Services are also subject to our Privacy Policy and any additional guidelines, plan descriptions, or policy notices made available through the Services, each incorporated by reference.

2. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via the Platform or your account email. Continued use of the Services after updated Terms take effect constitutes your acceptance of the revised Terms.

3. Account and Registration

3.1 Account Requirements

To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Services. If you are under 18, you must have permission from a parent or legal guardian.

3.3 Account Security and Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Business users must have the authority to bind their entity to these Terms. We may suspend or terminate accounts for violations of these Terms, legal or security risks, nonpayment, government requests, or prolonged inactivity. You are responsible for maintaining your own backups of any data or content stored through the Services.

4. User Conduct and Prohibited Activities

4.1 Prohibited Uses

You agree not to use the Services to:

  • Exploit, harm, or attempt to exploit or harm minors in any way
  • Generate false, misleading, or deceptive scientific information intended to cause harm
  • Misuse personally identifiable information of any individual
  • Infringe upon the intellectual property, privacy, or other rights of third parties
  • Engage in harassment, abuse, or any form of harmful behavior toward others
  • Generate content that facilitates fully automated adverse legal decisions or discrimination
  • Produce content that violates applicable law or publisher/journal/marketplace policies
  • Use the Services to provide regulated professional advice (medical, legal, financial) without appropriate qualifications and disclosures
  • Generate, attempt to generate, store, or distribute sexually explicit content, nudity, pornographic material, or any sexual content of any kind
  • Generate, attempt to generate, store, or distribute child sexual abuse material (CSAM) or any content that sexualizes minors. All generated content is subject to automated moderation and may be reported to the National Center for Missing & Exploited Children (NCMEC) or equivalent authorities. Violations result in immediate account termination and law enforcement referral
  • Generate deepfakes, photorealistic impersonations, or non-consensual depictions of real individuals — including political figures, celebrities, and private persons — without their explicit written consent
  • Generate content depicting graphic violence or gore, weapons or weapon manufacturing instructions, or content promoting hatred, discrimination, or violence against any group based on race, ethnicity, religion, gender, sexual orientation, gender identity, disability, or other protected characteristics

4.2 Technical Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the Services
  • Remove or alter any proprietary notices, labels, or marks
  • Commercially exploit the Services themselves (as distinct from using Output commercially)
  • Use automated tools to scrape, crawl, or extract data from the Services
  • Upload or transmit malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to any part of the Services or related systems

5. User Content, Output Rights, and Commercial Use Authorization

5.1 Definitions

"Input" means any text, images, sketches, PDFs, prompts, or other materials you provide to the Services. "Output" means AI-generated scientific illustrations, figures, diagrams, and related materials produced by the Services. "User Content" means your Input and any modifications you make to Output. "SciFig Materials" means all software, algorithms, models, documentation, and other intellectual property comprising the Services.

5.2 Ownership of User Content

You retain all rights, title, and interest in and to your User Content, including any Input you provide to the Services.

5.3 Rights in Output; Commercial Use Authorization

Subject to your compliance with these Terms, SciFig grants paid subscribers a non-exclusive, worldwide, perpetual license to use, reproduce, modify, display, and distribute Output for any lawful commercial or academic purpose. This includes the right to use Output in academic publications, journal articles, conference presentations, textbooks, grant applications, and other professional materials. These rights survive subscription cancellation for all Output generated during an active paid subscription period. SciFig does not claim ownership of raw AI-generated Output.

5.4 Free Plan Restrictions

Output generated under a free plan is limited to personal, internal, non-commercial, and non-publishing evaluation purposes only. You may not use free plan Output in any published work, commercial product, or public-facing material. Commercial or academic publishing use requires an active paid subscription.

5.5 Modifications and Derivative Works

You may freely export, edit, crop, annotate, modify, and incorporate Output into derivative works, including combining Output with other materials. SciFig claims no ownership in any user modifications or derivative works you create.

5.6 License Grant to SciFig

By using the Services, you grant SciFig a limited, non-exclusive license to host, store, reproduce, process, display, and transmit your User Content solely for the purpose of providing, maintaining, and improving the Services.

5.7 User Responsibilities and Warranties

You represent and warrant that you have all necessary rights, licenses, and permissions for any Input you provide, and that your Input does not infringe the rights of any third party.

5.8 Disclaimer Regarding AI Output and Third-Party Models

Output is generated by artificial intelligence and may be inaccurate, incomplete, biased, or non-unique. In particular, AI-generated scientific illustrations may contain errors in biological structures, molecular representations, pathway diagrams, anatomical details, chemical formulas, or other scientific content. You are solely responsible for reviewing and verifying the accuracy of all Output before use. SciFig assumes no liability for manuscript rejections, retractions, or any consequences arising from inaccuracies in Output. SciFig operates as an application layer integrating third-party AI models and does not guarantee the scientific accuracy of any generated content.

5.9 Publication and Marketplace Policies

You are solely responsible for ensuring that your use of Output complies with the policies, guidelines, and requirements of any target publisher, journal, institution, or marketplace. Different publishers may have varying policies regarding AI-generated content, and it is your responsibility to verify compliance before submission.

6. Paid Services and Payments

6.1 Paid Services

Some features of the Services are available for free, while others require payment through a subscription plan or credit purchase. SciFig reserves the right to modify, add, or discontinue any paid or free features at its sole discretion.

6.2 Purchase, Billing, and Renewal

Payments are processed through third-party payment processors (including Stripe and applicable app stores). By purchasing a subscription, you authorize automatic renewal billing at the then-current rate until you cancel. Subscription credits reset at the end of each billing cycle. Purchased credit packs do not expire.

6.3 Refund Policy

Refunds are available only for first-time paid subscriptions, provided the request is submitted within 7 days of the original purchase date and less than 10% of the subscription's included credits have been used. Each user, account, and device is limited to one refund. Subscription renewals, plan upgrades, and credit pack purchases are non-refundable. Refunds may also be issued for verified billing errors (such as duplicate charges) or where required by applicable law. To request a refund, contact [email protected].

7. Intellectual Property Complaints and Repeat Infringers

SciFig respects the intellectual property rights of others. We may remove content that infringes on third-party rights and may terminate the accounts of repeat infringers. If you believe your copyrighted work has been infringed, please contact us at [email protected] with the following information: (1) a description of the copyrighted work, (2) identification of the allegedly infringing material, (3) your contact information, (4) a statement of good faith belief, and (5) a statement under penalty of perjury that the information is accurate.

8. Third-Party Services

The Services may incorporate or rely upon third-party technologies and services, including large language models, image generation models, APIs, payment processors, cloud infrastructure, and analytics tools. Your use of such third-party services may be subject to their own terms and conditions. Any disputes with third-party providers are solely between you and the relevant provider.

9. Disclaimer of Warranties

THE SERVICES, ALL SCIFIG MATERIALS, AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. SCIFIG SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. SCIFIG DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCIFIG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. SCIFIG'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES PAID BY YOU DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless SciFig, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services or Output; (b) your User Content; (c) your violation of these Terms or any applicable law; or (d) your infringement of any third-party rights.

12. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles. Before starting any formal dispute, you agree to contact us at [email protected] so we can attempt informal resolution in good faith; we will respond within 30 days of receiving your notice. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that: (a) if you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction granting mandatory consumer protections, you retain the right to bring claims in the courts of your country of residence and the mandatory protections of that jurisdiction shall apply; and (b) either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property, confidential information, or to enforce these Terms against misuse of the Services. Nothing in these Terms excludes or limits any rights or remedies that cannot be excluded or limited under applicable law.
